Officers Loyalty and Deadly Force:
The clip on above depicts the dilemmas that guards faced while employed at
shawshank prison. Were fellow officers could commit any heinous crime and not
fear any form of retribution in the legal system. For the officer knew that the
fellow officers would never give up another cop. This kind of loyalty to your
fellow officer is what is called a code of silence or at times could be called
the Blue curtain of secrecy. A code that
knows no bounds, even if the unethical transgression results in a man’s untimely
death. Because the only thing that is important is that the unspoken rule is
followed. The rule which sates an officer
is to not to come forward when they are aware of ethical transgressions of
other officers.
This scene also, demonstrates the use of deadly force. The actions taken by the correctional officers to silence an inmates cries goes above and beyond the legal recommendation of force in these types of situations. According to "Ethical Dilemmas and decisions in criminal justice written by Joycelyn M. Pollock". it states "police have an uncontested right to use force when necessary to apprehend and or subdue a suspect of a crime." But, when officers use of force starts to exceed their lawful purpose or the purpose is not lawful it is not justified, or when force is used to hurt or coerce an person it is also seen as unlawful. so, in relationship to the scene above that is a use of force to inflict personal pain in retaliation for the guards not being able to tolerate the imates crying. which is a criminal act and by law is considered a form of murder. making the guards no better then the prisoners that they are in charge of. |
